Good luck with this. I'm sure you know that non-financial terms are not binding or enforceable in a prenup (e.g those related to children, giving birth, etc.). As for the financial terms, you need to make disclosures of all property, bank accounts, etc.; both parties should do this, and attach it as exhibits to prenup; give her several weeks to consult an attorney, and make sure you have an attorney review everything and that is enforceable in your jurisdiction. I'm 40 and after my first marriage, which was a disaster and cost me tons of $$$, I am now in stable partnership with an awesome woman. We chose not to marry to avoid the legal formalities and things are great. I still treat her as my wife and she treats me as her husband.

No children shall be brought into the marriage until marriage is stable. Starting with 2-3 years of stable marriage. Wife will not carry or birth child. Husband will provide a surrogate mother and assume all financial responsibilities with surrogate. Wife has ultimate decision if marriage is stable or not.

The whole purpose of marriage is procreation. Getting married means you are in a stable relationship and are ready to have children.

With the surrogate she is basically saying I am marrying you to get your benefits (house, maintenance), but you are still out on your own to have a child with someone else.

This has to be the mother of all red flags. Even if it is something here lawyers convinced her of putting, knowing it will get thrown out later during negotiation, I would leave her just for even attempting to use this.

Or just don't go through the legal process, keep the government out of your relationship, and have a relationship. Marriage is a defunct ritual with antiquated applications. You can do everything you want to do without getting married.

Ok so correct me if I'm wrong. You asked for a prenup consisting of only number 1 and than in response she added 11 more as her counter proposition.

This is just pure bonkers. I wouldn't advice to marry anyway, and with thinks as you describe it would be even more stupid thing to do. Best luck.

Stop everything your doing right now, first and foremost go speak with an attorney about prenups and have them draw up the document. Then have future-wife hire her own attorney to review the agreement and provide feedback. There will be some discussions and you will know very quickly if she's looking for an exit strategy, in that case you can just bail on the whole thing.

This is a business contract and is treated as such. It must follow the rules of business contracts in order to be enforceable, and if it does then your ass is covered.
