You are correct. A quick and easy way to get a ball park is to look up the value of your home on Redfin or Zillow. Take that value and subtract the remaining mortgage. Divide that in half and that is what she needs to pay you. This is just ball parking. You two will probably need to hire an appraiser to determine the real value of the house, and then have your lawyer put that into your divorce decree. Make sure he includes a deadline for her to sell the house, or she might just drag her feet.

I just wanted to get our financial and personal lives separated as quick as I could. But if you two have children and she doesn't work it might be best to file jointly. The companies that made the loans don't care if you are divorced or annulled. All they care about is having two people by the balls to make the payments. Talk to a lawyer, but I think you need to go back to the judge and say you want to refinance both loans and ask him to give you title. I did a Quit Claim with my ex-wife. The Quit Claim won't get her off the mortgage. The Quit Claim will get her off the Deed. As far as the mortgage company is concerned she will still be responsible for the mortgage.

Unfortunately, unless you have a Court Order awarding you the entire house what you have just done is an illegal eviction. This could really hurt you during your divorce proceedings. Yes it does. She has to be married to you for 10 years or more years of your time in the Military. If she's only married to you 10 years of a 20 year service she would only be entitled to 25% of your retirement. And if she is married to you for the entire 20 years of Military service she gets the 50%. But the Military did away with the 20 retirement a few years ago. Now they have some kind of 401K system. But I'm sure the ex wife would be entitled to part of that too incase of divorce.
