I’m 4 months in. It’s the hardest in the beginning bc you get no chance to contest and can’t see your kid(s). Wouldn’t wish it on my worst enemy. Guardian Ad Litem has been the only route I’ve seen (and used) to fight custody time when push comes to shove. You’d be able to show them your schedule, how you can and want to be with the kids as much as possible, fight any issues/reasoning your STBX is asking for 80/20. I was at 5 hrs/wk supervised fighting a silver bullet divorce and am now at 20 hours after 2 months with a path to 50/50 all because of the GAL’s reports. Good luck!

Good luck man! Not a lawyer, but if you can reference best fit laws of your state (aka best situation for your kid) and how important a dad is, how much they need you and how hard you’re willing to work- it may help sway a judge. Also if they do push for that level of custody, you could say you’re working to get a job and if acquired you’d like room to gain more custody. Will let you know on July 1 after the GAL presents his recommendation. The GAL feels like the best bet to share your side, use witnesses, share things that might not be court admissible, etc. it’s horrible and lasting way longer than I thought. I’m 3 months in and have seen my kids for <40 hours total. But, you can beat it. We all can.

Hey I’m in this right now. First have your attorney push for a GAL, a lawyer for the kids. This gives them representation and will let a lawyer influence the judge on how much custody you should get (not just rely on her/her lawyer). Then yes you need to do supervised visit first. I’m doing it right now. In theory it can be free if you have a family member or mutual friend. Theres also counties who have programs/facilities who will let you do it there for free. Look into this. Hey man, I had the same situation (almost identical) and 2 little kids. I was living in a separate room for a year, and did everything I could to be a grey rock. Man we’re dealing with the same kind of monster then.. I had 4 weeks and then was able to move to supervised. Still only <20 hrs in 2 months. Just remember to be patient (I know how impossible that is), and that you’ll get a chance to tell your story eventually. Most importantly the kids will know in the end what really happened. Had one today too, they bumped my supervised hours from 5-6 because the GAL hasn’t had enough time to interview witnesses… though he started 3 weeks ago. Very frustrated at this system and how people can abuse it if they want to. Best of luck brother - hope yours turned out better than mine!

Ah man I’m sorry you had to go through this type of situation. We married a similar type of person and I worry mine will go on for years. Man I totally get a money scam but I just wish it didn’t mean a time scam too. I’d pay a huge subscription fee just to hang with them, which I guess is what’s kind of happening in the whole process of divorce. I’m doing as much as I can to avoid high attorney fees but already paid a lot and now a GAL on top of it. Unfortunately it’s necessary for who I’m going against. Yes! Ok am in the same boat you are. It sucks- but my lawyer asked the judge to forego mediation (the typical next step) to go straight to assigning a GAL. That lawyer then represents your kids best interests exclusively and will interview both parents, observe parenting time, talk to witnesses if necessary, look at evidence from both parties, etc. the downside could be it costs more money and your opposition may have ‘evidence’ that does damage your reputation/claims. My county court required I take something called Children in Between- which can be done virtually in 4 hours. I learned a lot and would recommend. Also get a GAL I’m starting in a similar spot but if you have an objective 3rd party making the recommendation for parenting split/schedules that’s your best bet IMO. You can also show them any evidence that isn’t normally ‘admissible’ in court. Best of luck brother!

Yo get your lawyer to have a GAL assigned. They will go through any relevant evidence and push for what’s best for the kids. Most of them are looking for why it should be 50/50 rather than one side or another. It’s what I’m going through right now- it’s expensive bc it’s another lawyer to pay but I think we’d all agree any amount of money is worth the time with our kids!

That’s going to help you immensely! The court leans their way so often and you don’t get a say if they record and build a story (however innocent it may feel to you). I don’t want to scare you but I had a similar thing happen and am ruined. My advice: just turn on your phone voice recorder whenever you’re in the same room. Be careful brother my wife started recording me and then used it to get an order of protection and now I’m fighting for dear life to see my 4 and 1 year old kids again. Ah man I’m sorry I had a very similar experience. Our relationship lasted another 2 years but it wasn’t the same after.. the therapist just helped validate her (at least that’s how she took it). And in my case I was pushed to an edge and now I’m fighting a big uphill battle. While I was hoping for stories that made me feel better in the short term, the truth is more valuable at this point. I found a really good one. The funny/sad thing is I have emails from both the dad and brother directly to her about how she withheld food from her mom when she was supposed to be her caretaker (dementia) and talking about how she’s always been a problem.
