Everything in that article is an insult to statistics everywhere.

Most of that massachusetts study talks about legal custody not physical custody. Joint legal custody is implied in many states once paternity is established. This has zero bearing on visitation.
Even in the sections that it does purportedly talk about physical custody. Joint physical custody doesn't imply a 50-50 schedule. Two weekends a month is marked under the joint custody column. Some states don't make a distinction between primary and joint. I.E. One parent can be the primary custodian, while the other is joint.
The specific stat you've cited was a survey of attorneys. It wasn't a review of case outcomes. With a 5 year review of different attorneys in different states. How could there possibly have been a consistent standard?
Check the hypothesis. It's specifically measuring cases where Fathers were seeking custody, and what they got. It doesn't measure the converse Mother's seeking custody and what their results were.

All of this ignores the elephant in the room. 40% of births are to unmarried couples and women get full custody by default. In any contested custody situation women have a huge starting advantage. Saying that 'more men are awarded custody in litigation' completely ignores that women don't have to litigate to gain custody.

These appear to reflect what happens when the case is litigated. That is hardly all or even a majority of cases. What happens when the case is litiagted is important, but what is much more important is finding out why the other cases are not even litigated, and what the stats are for those cases. Litigated cases where there si an actual court fight over cusotdy probably make up a fraction of the overall picture.
