The reach of the internet/web means that just communicating with peers is no longer a good excuse for libel. It's a public forum, the story was picked up by well-known music sites, and it has done real damage to his reputation. But what really disappoints me about this is that Right to Speak Out says that "[e]ven if Ms. Faircloth was not truthful" Oberst should still drop the suit. That's fucked up.

Take her for everything she's got, Conor.

i hope he wins his lawsuit. it may give pause to anyone else considering making a false rape accusation.

Women should be discouraged from making public rape accusations. They should instead be encouraged to make their report to police.

Oh yeah? Well vilifying discussion of false sexual assault claims by condemning the filing of this lawsuit only adds to the problem of false-reporting that allows false claims of sexual assault to proliferate at alarming rates.

They spare no effort in trying to deny her accountability:

"Ms. Faircloth did not send out a press release or seek personal benefits, but rather was communicating with peers," say Right to Speak Out of Faircloth's claims."

Yeah, and? Slander is slander. Besides, when she slandered a celebrity like Oberst, she surely menat for the word to get spread all over.

"According to a February 19th statement by Oberst's representative, all proceeds from the lawsuit will go to charities for victims of domestic violence," Right to Speak Out added. "As an organization dedicated to mitigating the harm that lawsuits like Oberst's stem from and amplify, we find this more than ironic."

So they are the sum total of all groups working agaisnt DV? Quick question - how many men do they help? Didn't think so.

"It is offensive to imply that filing such a lawsuit is a respectable way to procure money regardless of what he declares he intends to do with it," they continued. "Even if Ms. Faircloth was not truthful, vilifying discussion of sexual assault by filing such a lawsuit only adds to the problem of under-reporting that enables sexual assault to proliferate at alarming rates."

First off, it's not their call to say what he does with whatever money he gets, and not their call to say who accepts it. They are not the gatekeepers for DV funding.

Second, Oberst's action helps correct an equally bad but much less addressed problem, lying false accusers, whereas their efforts are enabling those false accusers.

So let's see:

Can't arrest women who make false allegations, because that would stop women from speaking out.

Can't sue women from making false allegations, because that would stop women from speaking out.

Can't do anything that requires women to take responsibility, because that would put limits on women's behavior.

Well if women need to be protected that much, how about we have them all dress in burqas and not be allowed outside the house without a male escort? If they need that much protection from bad consequences, then that's the logical choice. It would protect the women of the society from abuse/rape and protect the men from false allegations. It's a win/win for both genders.
