Absolutely

Restraining orders should be given to protect a person. Not to be kept out of one's home

So if the wife feels threatened, she can go to a safe place and order him to stay away. That would be something that does not require a big burden of proof.

But kicking someone out of his own house?

It is even worse because a recently moved in live in girl friend can expel a home owner and start a garage sale selling off his Bose stereo and stuff. This has happened.

I can definitely say I've seen spurious restraining orders against male relatives.
