This seems like something that follows an insanity plea but without the defendent being institutionalized. It also seems too easy to abuse. Lastly, couldn't it almost be called reckless endangerment on the part of the woman if she knew she was having medical issues but never saw a doctor? Hazy memory and unusually aggressive behavior strike me as unusual and are marks of mental health problems.

As an American practicing attorney, I'm glad this is from Australia. I'm also thankful for the American legal application of the "reasonable person", which excludes the possibility of rationalization/justification of illegal acts taken by a female encountering normal physiological processes that all women undergo.

It should NEVER be allowable as a defense, UNLESS I can claim "cortisol" or "testosterone (or whatever) made me beat the crap out of feminists because they stressed me out (or whatever other male hormonal defense you can conjure up). Pure bullsheite.

Women are just as good as any man as so women deserve the same rights and same level of success.

At the same time women have unique issues that make it unfair to expect them to share in the same responsibilities and failings.

Standard double standard.

PMS can be used as a defense, but not as a reason to fire someone.
