You never got any certified letter about paternity? I don't think they start garnishing without attempting to contact the father. I would look up info on the state's CS site and contact the appropriate dept for contested paternity. Good luck.

This is why you should adjust your W4 so that you don't GET a "refund" but instead you need to pay in a bit at the end of the year.

It's a LOT tougher for government agencies to confiscate funds when they don't already have possession of them.

Oh... and you need to get an attorney.

You should not allow the government to withhold from your check. You can opt out of check withholding and instead pay your extortion fee when it comes due at the end of the year. You will get interest on this cash you save throughout the year as well as not having to deal with this sort of non-sense.

If you have a job and your wages have not been garnished, it's quite possible that you're a victim of mistaken identity. It could have been as easy as a typo, or having the same name as a child support debtor.

I am not a lawyer and this is not legal advice. If I were you, I would start by calling Child Support Services at the number given and explaining the situation. I would do so on a speaker phone with a witness present, and I would take notes. I would send a written follow up statement, return receipt requested, explaining that I owe nothing, and demanding that they return the money that they improperly took from me as soon as possible.

Pasting the text of the self post:

So, I'm waiting for my tax return and instead of getting it I get a notice from the Department of Treasury stating that my refund is being used to pay a debt through Child Support Services.

Where do I even begin to contest a parenthood claim from 1500 miles away? The letter includes some basic information about Child Support Services and gives a contact number, but it would seem I've already been legally declared the father of some kid that isn't mine in a state that I haven't lived in for five years.

Does reddit have a clue where to start? After contacting the IRS and Child Support Services, where do I go to contest the claim of parenthood?

Help?
