If you don't want a kid you should always use a condom. I'll just point that out first.

Secondly, a woman can be absent minded and forget to take her pill. She could be on medicine that negates what the pill does, she could've been a derp and taken her pill an hour later than she usually does.

So it turns into a lot of moral gray area over whether it was intentional or accidental.

Broken condoms can cause a lot worse than pregnancy. She had an infection after terminating the pregnancy he caused her, as well. I'm sure those things were taken into consideration more than the mere fact that he was lying about the birth control.
