I've said this before. I don't think a lot of people making this argument have much experience with alcohol. They have seen people passed out after having drunk too much and assume that's what black-out drunk is. It is not. You can be so drunk you don't recall what you did the next day, but still sober enough to walk and talk and make decisions like a normal person.

Not everybody can get in that state. It depends on how your body tolerates alcohol. Some people pass out long before alcohol affects memory. Some people have it affect their memory long before they pass out.

The important point is that if somebody wakes up the next morning with a foggy memory, it doesn't mean they weren't in control of their faculties and it doesn't mean that they were unconscious.

I think a lot of people are under the mistake impression that it does. In that case, they believe that anybody who was drunk enough to have impaired memory must necessarily have been unable to make decisions and unable to consent. It's logical to consider it rape if you include as an axiom this mistaken belief.

The idea that drunk people can't consent doesn't seem to be respected in the UK outside of courts. The UK also has a binge drinking culture. The drunken consent issue is more widely respected in the USA. The USA is also much more puritanical when it comes to alcohol. I don't think this is a coincidence.

I believe the idea that drunken consent doesn't count is something that is mostly born of ignorance of the realities of intoxication.

She was blacked out. To the point where an EMT legally could not have released her from his care. The line of how drunk you have to be before you're unable to give consent may be blurry, but in this case it is not. She was very clearly too drunk to consent by anyones standards. That was rape.

I don't post much in MR, but this conversation was driving me nuts. It's OK to prosecute drunk drivers for making poor decisions while drunk, but you get hammered at a frathouse, hit on a guy and sleep with him, and he's a rapist.

Nope.

The ents are especially laidback and kindly, and so do not tolerate such inflammatory things on the ent subreddits.

Apparently some people didn't learn anything from the recent fiasco regarding the zombie makeup girl (something I'm glad I stayed on the fence about).
