My wife has made some really poor decisions that have seriously impacted our relationship, at this point it's as good as dead. She gets high constantly and the last four or five nights she's gone out and not come up until 4 or 5 in the morning. She doesn't answer her phone when she's out or anything. We are currently getting evicted from our home which my wife has never once lifted a finger to clean. When I got laid off from my job she refused to even look for part-time or temporary work to help with the rent/bills. She's also taken my daughter and kept her out either all night or very late. I tried to call the cops to keep her from taking her but was told they couldn't do anything to stop her. Short of getting in a screaming match playing tug-of-war with my daughter I don't know what else to do. I went to family court last week to try and file for custody but was told I can't as long as we're both still living in the same place. We currently live in NYC and I'm expecting a large chunk of money within the next few weeks. My family has an empty, furnished two-bedroom apartment in Indiana that they offered to let us stay in for a couple of months until we get the money and get back on our feet. My wife refuses to go. She insists that she is going to take my daughter and go stay with her mother that lives in a one-bedroom section 8 apartment with her grown 26-year-old son and her boyfriend. At this point I just want the relationship to be over with and move on with my life. Please, if anyone has gone through this and has any suggestions on how best to go about getting custody I would really appreciate any advice.
