Ah I was waiting for this to get reposted here. I won't repeat what I have said elsewhere on this matter, but I will say that I don't consider this a men's rights issue. It's a human rights issue; his gender is incidental.

Rather unique situation. Applying the same logic that make paedophilia illegal to this situation is rather flawed don't you think?

He's enjoying it. He wants to do it and he (most probably) isn't capable of growing to understand, regret and get hurt by it. He can't suffer from it. Sure if you applied the same logic to a coma patient you'd get a crowd of outraged people but he's mentally at his most functional point of understanding and reasoning. Where's the harm honestly?

Plus I had an IQ of 131 at age nine (equivalent to an average 17 yearold). Could I have gone to court to get made legal on that ground? The age of consent here is 16.

I'm divided on this... it clearly sets an awful precedent, but at the same time...

What if this man can't understand things like STI's? Does the understand that sex can have serious consequences? How can you consent if you're mentally unable to understand the consequences of your actions?

This isn't punishment, no one's saying that he's done anything wrong, it's a case of the state looking after someone whose been deemed not fit to be able to take care of themselves.

I suppose that I don't agree that this is the sort of decision a judge should make, but that perhaps if a panel of experts were to evaluate the man comprehensively and come to an informed decision on whether the man is capable of consenting, then maybe this type of action could be taken. But this judge has overstepped his bounds.

We don't hold animals to human standards from a legal perspective.

He certainly can, especially if isn't capable of understanding the risks posed by STI's. Is this person capable of understanding that having sex could lead to a terminal disease?

You're confusing intelligence with maturity though. You need to have a certain level of intelligence to be mature, but that doesn't mean just because you have a certain level of intelligence you are mature. No one (I should hope) thinks that on the day you turn 16 you're instantly mature enough to consent and the day before you weren't. It's a baseline we use because that time comes differently to all of us, but for the sake of the law there has to be a cut off age. It's not a good system, but it's better than all the alternatives.

Anyway, those are my honest opinions.
