the law as it currently stands says that being drunk is not an excuse to rape.

That if a women is so drunk that she is incapable of understanding the nature of the act then it is rape. But just because she drunkenly gives consent when if she was sober she might not have consented doesnt make it rape.

It was quietly dropped in 2007 after Sir Igor Judge, who has since become Lord Chief Justice, ruled in the Court of Appeal that women are still capable of giving consent even when they are very drunk.

He added it would be impossible to draw up general rules on whether or not someone is too intoxicated to say yes.

So which one is it "Lady" being drunk means people are not responsible for their actions or being drunk means people are responsible for their actions ?

Or maybe she just means what we already know :

Men are responsible for their actions while drunk, women are not ...

They tried to push laws like this in the US. Personally I always argued that the way these laws work a woman who is too drunk to drive can't be held responsible for her actions while driving drunk.

Also, I wonder what kind of a shitstorm there would be if we tried to push laws that stated "drunk men can't be rapists since they were unaware of their actions".

Would it be so hard to make these things gender neutral?

If sex with a drunken person is supposed to be rape - O.K. That isn't the end of the world. Clearly a drunken person is not responsible in this scenario. But that should mean that, if both parties are drunk, then neither are responsible.

And thus we would have a law that would be based on equality and fairness. People might complain, but at least it wouldn't be discriminatory.

Remember, it is only rape in this instance if you turn out to be unattractive/poor.
