How is Obama responsible for this? The courts themselves have made rulings that produced these kangaroo courts. Dept of Ed. OCR is under the executive and thus the implementation was via the executive, but the requirement came from the judicial branch. Real courts ruled that due process was required.

There are massive issues with Title IX implementation but blaming the sitting president isn't correct here. The issue stems from executive overreach and that predates Obama. The core problem is allowing the executive to set the rules by executive order, and carrying out enforcement with an executive agency (OCR) when the issue is clearly the domain of the judicial.

It is far too simplistic to point at a president and assign blame. It is an institutional failure of checking executive overreach. Every president has furthered this overreach. Clinton, Obama, Trump, Biden. They all played ideological power games using Title IX as a weapon with little to no oversight from the judicial branch.

When the judicial does make rulings, OCR has often ignored them regardless of the current administration. For example, courts ruled that live cross examination in Title IX hearings shouldn't be required in all aspects of cross examination. This is because the current requirement was out of line with current court requirements for cross examination (rape victims can have cross examination that isnt live). OCR turned around and said they no longer enforce cross examination at all. Not that it isn't required, they just won't enforce it.

Blaming a president doesn't make sense and doesn't strike hot at the issue that produces this. It is only an unproductive and divisive blame game that detracts the discussion from focusing on the underlying cause.

The "dear colleague" letter was NOT an executive order.

You are absolutely right. Still, OCR can't legally change policy without direction from the executive. It is supposed to be an executive order but the fact that it isn't is also a sign of a problem. Title IX has been heavily interpreted by OCR. Each little step they say "this isn't anything new" until we have gone miles from the original intent.

he didn't. He let it roll. That's what I'm pointing to.

I agree on that. He didn't really commit either way. Either sign the order or don't. He really should have stepped in and said "this is too far, we need to pull back interpretation if it means the executive is running fake courts." It was a responsibility and he should have stopped it.

The underlying problem is bigger, but I think I see your point on Obama now.
