Unpopular opinion in America but minor is not the same thing as child. If this is a 16 or 17 yo student, absent a showing coercion or unwillingness, the teacher should simply be fired and lose her teaching license.

There was a story where a woman in her 20s became romantically invoked with an 18 yo. She wound up marrying him and the da dropped the case bc of problems with spousal privilege.
