No, but he can split custody of the child. I knew a woman who moved from Utah to New York with her child. The son's father (they were never married) stayed in Utah, and the son spends the entire summer with him.

He has no legal recourse without a judges order of custody rights.

If your friend wants to be a father to his child, he needs to have a legal custody document that outlines what his rights are. That CAN include an order that the mother isn't allowed to move the child out of state, but without such an order the mother is free to do whatever she likes.

As to child support, there's no defense to that at all. No matter what state or country she moves to, he'll be on the hook.

Your friend should contact an attorney, father's rights groups, and/or child protective services. One of these groups should be able to give your friend some advise and possibly get it so she can't leave the state. I know it has been done in other cases. Also he should be advised as to best protect his rights as I believe it is best to make your intentions known early. Of course a paternity test is also always good advice.

And parents are always required to support their children no matter where they live, even if it is on different states.

Also have your friend save all text messages and all communications. It's very telling that you say she is "threatening to move out of state". The state the child is conceived in and the state where the parents are established can be used as the jurisdiction to manage the case, and the local court can order her not to leave. also if it is proven that the mother is interfering with the father's ability to have a relationship with the child will not look good for her. So if it appears she is moving to spite the father or to cut him off from a relationship, it may go in his favor if he should want full custody. Tell your friend to watch what he says because she is also likely saving all communications. Mske sure he comes off as supporting and level headed.
