Hey all, for context I'm not all that familiar with the law in the U.S. or anywhere else at all really.

When reading about certain false rape accusations and whatnot I routinely come across cases where a woman not only makes a completely and utterly baseless and false accusation but also makes an accusation that can easily be disproven (one example off the top of my head). Despite this, men falsely accused of rape often seem to have to spend at least an entire year or perhaps a few months in jail/prison merely because a woman claimed he had sexually assaulted her. Even if we're assuming the men in question don't get charged with anything at trial, the notion that they have to be imprisoned as a 'provisional' measure without any sort of proof whatsoever until a trial has been set has always been a scary thought. If you think I'm misunderstanding how these 'pre-emptive' arrests and imprisonments work, please feel free to tell me, but as far as I understand it this is how it works in most western countries.

One year or something close to that might not seem like a big deal to most people, but a false rape accusation can very well destroy your life within one year. It can get you kicked out of educational institutions, permanently destroy your career, marriages, families and personal relationships among many other things. It can even get you in a situation where you'd be actually raped in jail and manage to contract sexually-transmittable diseases. I can imagine that spending an entire year waking up in a concrete jail cell every day for something you know you didn't do is a highly traumatic experience.

So some of the related questions I have are, how easy is it to find yourself in a situation like this and how do we prevent these 'provisional' imprisonments? Is there some legal jargon lawyers have more expertise in that prevents men from being imprisoned for over a year until a trial even begins? Or are men going to continue being subjected to witch-hunts by hateful false accusers assisted by authorities? Is it possible to compensate these wrongly imprisoned individuals later on or pursue legal actions against institutions that punished them for unproven behavior/crimes? How can the accused better gain anonymity at least until they're proven guilty?

I believe in trials and the right of everybody to have them, however what I do not believe in is traumatically disrupting the life of men, especially younger men, by at least an entire year as authorities 'figure out' what to do with them as they become social pariahs and have everything they worked for on the outside crumble. The situation is already bad enough for falsely-accused men if they don't get charged, but I am also under the impression that a testimony or instead one or two colluding witnesses could very easily send you to prison for life. Even if there's no real physical evidence being presented or the accusation but I'm not sure about that.
