Having spent a brief time in Alabama during my HS years, I can tell you that it's not unrealistic to find a student who is 19.

Looks like the dismissal was without prejudice, so the state can refile charges if they show that consent was gained through the use of the teacher's position.

It's truly bizarre that a low-level trial judge would declare the statute unconstitutional to begin with. That's usually an issue for appeal, or a higher court to take up, not for someone at so low a level.

It reeks of political activism. It's outright unheard of.

Is it that unusual though? Almost all of the decisions of an appellate court come from trial court decisions, and if a constitutional issue is presented at the trial court level, they will rule on it. However, it's not binding on other courts or the state until it's ruled on at the appellate level.

What's nice is now the appellate court can verify the law for future convictions through case law.

If you're 19 and in high school you're mentally retarded, so it's sexual assault of a mentally diminished person.

Further:

Though the age of consent is 16 in Alabama, a law was passed in 2010 that made it a felony for a school employee to have sex with a student under 19 years old.

And one of the students was 16, the other 19. This judge has no grasp of the law.

Judge Thompson said that position of power 'clearly does not exist between every school employee and every student regardless of where that student is enrolled.

I'm sorry, but if you're a teacher, and you can't command respect from the students, then you're in the wrong position.... or wind up in, ahem... in those positions.
