Does your stbx work? If not, there could be alimony involved. If she works but earns less because of earning capability, there could be alimony depending on length of marriage & difference in income (imputed). Since you don't have kids & assets, your questions should be around alimony. For the lawyer, I would explain the financial & personal situation & then ask 1. What is the process? 2. How should I protect myself from any counter claims? Dv, harassment, abuse, rape etc? Based on your experience, should you continue staying in the same residence as her? Should you move all your stuff out? Lease issues etc? 3. How will assets be divided? Bank locker, jewellery, shares, 401k, Ira etc? 4. What are your fees? Since, this is a simple divorce, can you charge one lump sum fee instead of hourly? How much for email, phone, copies, fax etc? 5. Does he have a paralegal who works for him/her? Who handles queries when he is in court or on vacation? Does he work evenings or weekends? Does he answer emails? How soon will he respond once you ask a question? 4 hrs? 8 hrs? 24 hrs? 6. Can he provide you the template of documents & you do all the legwork of filling in remainder to control costs? 7. How much is the retainer? Is it refundable if not used? How much is the replenishment once he exhausts the retainer? Good luck. Whatever u do, please be honest & fair. Anything you hide or misrepresent now is likely to keep u up at night in the coming years!!

I'd be sure to emphasize that you're looking for an attorney who is goal-oriented. There are lawyers who will drag the process out for both men and women, creating conflict that neither party wants in order to run the meter. You want someone who is looking to make the best deal possible but is also capable of being your attack dog if things get twisted.

Look up “Divorce Checklists .pdf” in Google. Make your own list from every checklist that applies to your situation.

Then start asking for free attorney consultations.

Gather as much info and educate yourself as much as you can before pulling the trigger.

It’s a process. It will give you more time to think and come up with better questions and answers.

I've been having the same thoughts to divorce my wife as well. She loves me, but I don't love her anymore. We have a child which complicates things. We make nearly the same, her a small bit more. We've always split our bills down the middle and don't have much w/ both our names on it other than the house we rent and a past vehicle we financed. I will be using the advice to do more research and put a plan in motion. I'm afraid to put it in motion because of the ramifications for our daughter and the financial situation.
