My very limited understanding of defamation law is that, in general, it's very difficult for a public figure (a politician running for office or a Supreme Court candidate, say) to file a defamation case and win because the burden of proof would be on the plaintiff. Also, defamation lawsuits involving political-related speech raise First Amendment concerns.

However, Mark Judge is neither a politician nor a Supreme Court nominee. As far as I know, he is a private citizen and it looks like he has been defamed as being an alleged accomplice in the allegation that Kavanaugh attempted to rape Ford. My limited understanding of defamation law is that when a private citizen files a defamation lawsuit, the burden of proof is on the person who made the defamatory statements.

So, if after this case is investigated, it turns out that Ford's allegations cannot be proven or supported (or were outright false and fabricated for political motives), should Mark Judge file a multi-million dollar defamation lawsuit against Christine Blasey Ford?
