Hey everyone. This sub has been very helpful during this past year. But I ask for some of your thoughts. I’m thinking of changing my attorney.

Background: I’m in NY. Divorce has been going on for a year now. My wife left the house for 5 weeks and wouldn’t let me talk to the kids for the entire time, they are 4 & 7. Covid closed the courts so I had to wait it out until they opened and she was ordered home. The judge immediately put into place a nesting agreement, not fun but it’s for the the kids. I get it. Almost immediately after I get served with an order of protection full of bs ( same old stuff) that was instantly dismissed and withdrawn. I’m clean. I’m the one filed for divorce.

A year later we’re still nesting. I’ve been brought to court 8x mostly for money and changes in custody, we have 50/50. The court hasn’t changed anything. On top of that my wife repeatedly breaks the temp agreement. Refuses to leave the house, comes when she wants, etc. I’ve asked my attorney to do something but he says let it go.

I’ve also asked for 50/50 in our agreements but I’m persuaded to take something closer to 60/40, even by my attorney. I may be able to get this closer to 45/55 but I’m not quiet sure what this means in the long run. I’m close to the kids and want 50/50.

Not only has my attorneys inaction been frustrating, it’s provoked my wife who’s gotten bolder. On top of that I was ordered to pay 10k for her legal feels even though I’ve never filed a motion.

I don’t want frivolous motions but it would be nice stick up for myself once a while.

Last thing, there are questions about the house my wife wants the kids to stay out. We’re getting closer to a trial and I’m being threatened by everyone how much I could lose but I’m not sure if this is true.
