Group,

Can you offer any advice???

My ex and I divorced a couple of years ago. For over a year now she has refused to follow the parenting schedule ordered by the court (yes I have proof). Instead of the 2-2-3 50/50 schedule with rotating weekends that was ordered, we are on a 3-4 60/40 schedule where I have the kids every weekend.

Why is this a problem? Well I pay support based on 50/50 + Alimony. Also (I know the court does not consider this) it costs a LOT more to support 2 kids all day Saturday or Sunday than it does to support them for a few hours after school on a weekday. There is food cost, utilities, & entertainment. ALL of the kids weekend outings & birthday parties are paid for by me.

Add to that if I want to go away on a weekend I have to pay for care or beg my ex wife for her help. On the other hand, she has every weekend free to roam the world child-free while my household parents her children.

I know my recourse is to file a motion for contempt & enforcement or to seek a modification based on the status quo. But that comes with a minimum $5000 retainer. I suppose this is more of a rant. She is just screwing me over and I get to choose whether to pay her monthly or pay a lawyer. 2 bad options! It shouldn’t cost me thousands either way just to have a just & equitable settlement!
