I've been asking and asked for 50/50 through lawyers but my ex refuses, thing is i work a 4 on 4 off shift pattern 2x 12hr days, 2x 12hr nights. This is the latest offer:
(a) Parental Responsibilities and Parental Rights
Except as specifically provided for in this clause, both parties shall continue to share the responsibility to safeguard and promote the children's health, development, and welfare, and to direct and guide them.
(b) Residence
The children will have their main place of residence with the First Party.
(c) Contact
The Second Party shall have residential and non-residential contact with the children as follows:
i. Residential contact for two exclusive weekends during each four-week period with collection from school on Friday and return to school on Monday;
ii. Residential contact for one night during the week with collection from school and return to school the following morning;
iii. Residential contact for one half of the school Easter, Summer, October, and Christmas holidays with Christmas day on alternate years;
iv. At such other times and on such other dates as may be mutually agreed between the parties.
(d) Major decisions affecting the children
The parties will consult each other and take account of the views of each other in any matter of importance affecting or concerning the children, including their health, education, welfare, development, and guidance. In addition, the parties shall, in reaching any decision in relation to the children, have regard, insofar as is practicable, to the children's views.
The parties will consult with and follow the advice of medical professionals in relation to the children's physical and mental health.
In the event that the parties are unable to agree on a matter of major importance affecting the health, education, welfare, development, and guidance of the children, they undertake, in the first instance, to attempt to resolve any disagreement with the assistance of an appropriately accredited mediator. In the event they are unable to resolve any disagreement between them, either or both remain entitled to seek a remedy through a Court of competent jurisdiction.
(e) Permission to leave the UK
Neither party will be entitled to remove the children from Scotland without the consent of the other, except where the removal is for a holiday of no more than three weeks' duration each year.
