Using a friend's account to stay anon. I could really use some help. I'm in GA and been going through a hellish divorce for a year and a half. All of ex's legal fees are being paid by my former church. I was in the ministry, the church is IFB (if you're familiar), and this divorce has become a vehicle to destroy me in every possible way for the unforgiveable sin of not wanting to be married to my abuser anymore and also not believing in their hypocritical nonsense anymore.
The divorce should have been finalized weeks ago, as bench hearing was May 22. I lost basically any real visitation with my teenaged daughters (who have been brainwashed and hate me) and I have extremely limited visitation with my 12 year old son (two overnights every other week week, no Sundays). This all cost me about $70k. I ended up losing my job in January and just started working again. Had to file for bankruptcy last week. Its been a complete nightmare and I just want it to end. But just when I thought it was finally over, more bullshit is being thrown my way. Here's the brief:
-Parties have been living separately since Jan 2022
-Divorce was filed in Feb 2022
-In April 2022, I prepared a joint tax return for 2021
-My income was $67,000
-spouses income was ~$6000
-Prepared tax filing was shared with my ex in April 2022 no objections or comments from her.
-I couldn't afford to pay tax debt, so filed for extension
-October 2022, taxes were filed electronically through turbo tax and I paid $1700 debt
-Several correspondences ensued regarding the shared debt (as assets were divided jointly in Jan 2021, I felt the 2021 debt should have been divided jointly)
-My ex agreed to pay 10%, I did not accept. I said I would wait until final settlement to resolve.-Feb 2023, on my lawyer's advice I filed my 2022 taxes separately and claimed my 3 kids as dependents. This seemed fair because under the terms of our temporary agreement, I was giving my ex 60% of my income and she was still only working part time.-Due to a withholdings mistake, I now had a new tax debt of $7700
-May 2023 pretrial, my attorney advised that court would not take up the issue of the 2021 tax debt. Further I was advised that for 2022, the judge would not direct my ex to file jointly or prevent her from claiming our 3 minor dependents for 2022. I was not privy to the details of these discussions, but at the time, I was aware that this would put me in further debt to the IRS to the tune of $3,000-$5,000 PS I'm pretty sure I had the worst firm/attorney in history.
-Settlement agreement was reached that day without trial and I never saw the judge.
-In the following weeks as the SA was negotiated, I was unable to continue to pay legal fees and my attorney withdrew from the case. I was now Pro Se. However, on June 2 an agreement was reached and I notarized and signed the agreement and sent it to OP
-One Monday, June 5, OC requested a copy of the 2021 1090 I had filed. I protested that it was irrelevant now and that OP should sign the SA. But OC aggressively demanded to see the 1090 claiming there were "discrepancies."
-When I accessed turbo to tax find the 1090 form, I discovered that a technical error had occurred and the taxes had not actually been filed. I wasn't even able to see the previous worksheet I had created. I called customer support and was told I had to redownload the software. I did so, reentered information as before and sent the documents to OP explaining what had happened.
-OC then informed me that the version of the SA I had signed was incorrect and asked me to resign the corrected final version.
-I told OC I would sign once OP had signed the corrected 1090 for 2021 so it could be filed.
-OC then told me this was irrelevant to the SA and told me if I do not sign, she will file motion to enforce and I will be responsible for resulting legal fees.-I contacted my ex and asked her is she intended to sign the 2021 joint filing. She replied that she was having it reviewed by a CPA. I'm getting very nervous that now she's going to file 2021 separately and put me in even more freaking debt. She did not reply to that question at all.
She emailed me again today saying her "CPA" wants me to clarify if the 1090 I sent her was an amendment or whether it was a new filing. I was clear about that when I sent it to her, but she's dumb, and now I don't want to reply because I'm scared.
What is she up to? How bad am I screwed? What should I do?Is there anything I can do? Should I just bend over and take it again?
