I am in a very contentious divorce battle, and I am trying to hang on financially as much as I can. Ex is on her fourth attorney and thanks to her my D4 can no longer goto montessori school. Recently, ex somehow tells me she is able to pay for D4 to get childcare on her days only. My fear is that I would still get stuck with the bill if ex stops making tuition payments. We have shared custody, so I need to agree to send her to this childcare in the first place, but I told her one of my conditions is that whatever contract is signed between her and the school needs to specify that she will be solely responsible for tuition.

I'm okay with sending her to school and having ex pay for it, but is the financial agreement between her and the school enough to protect me if she defaults?

More general question, if we goto trial, is it the case that all debt incurred while being filed and separated considered to be split or the responsibility of the person that incurred it?
