I’m have serious concern my ex is trying to move my children away as a means to limit my access to them, I’ve heard she’s planning this through mutual friends. We live in Canada and I’m looking for input on wording for a mobility clause that would make it difficult for her to up root our children. We have shared parenting status under Canadian law, not quite 50/50 but close, it took me five years and over $150K to get here despite two independent social workers supporting my position. We’ve been negotiating a settlement agreement and suddenly she’s added a clause that would allow her to move within 60km of the city which would also be grounds for adjusting the parenting schedule. It would be devastating for my children to leave their school and friends. Has anybody been through this or have recommended wording for an agreement to limit this possibility? I will not accept any clause that allows her to move the children away and I’m willing to have a hearing on this matter if that’s what it takes. Thank you for any thoughts you can share!
