“The statements I made and repeated online and elsewhere over the past six months accusing Conor Oberst of raping me are 100% false,” Faircloth said in a notarized public statement issued on June 14.

“I made up those lies about him to get attention while I was going through a difficult period in my life..."

Because false rape is a great way to,deal with a difficult time... /s

Faircloth later clarified her xojane statements in a Tumblr post titled “Conor Obers: Rapist.” The post has since been deleted and replaced with the words “tricked ya.”

I'm sure all is to be forgiven and forgot because it was just a simple joke right?...

And of course, comments are closed, just pathetic.

She posted under a pseudonym on xojane that Conor Oberst had sexually assaulted her.

She did not make a police report, sue him, or in anyway involve the authorities in her claim.

Her post went viral because Oberst is famous. It damaged his reputation.

Her real identity was established and he sued her for libel, for a million dollars, in order to have the opportunity to prove his innocence.

As a result of this suit, she signed an affidavit saying she lied and recanted her statement.

The civil suit did not go to trial, so she had no opportunity to perjure herself. xojane is not a court of law and lying there is not perjury. She never reported the alleged incident to law enforcement, so she did not have the opportunity to lie to authorities there.

Story is: Lied on internet. Oberst reputation damaged by rumor. Civil suit initiated. She recanted. In no universe would this result in jail time for her.

This is fallacious. If I drive home sober, but get into a car accident, am I "skirting just outside" the legal repercussions of a DUI?

Pre hoc, ergo propter hoc isn't a real fallacy, I made it up, because basically you are just talking about causality in a way that is trying to make causality seem like something more nefarious.

Here's an example of the argument you are making:

Person A had a glass of orange juice

People who have a glass of orange juice don't also have a glass of water.

Therefore, Person A did not have a glass of water.

It's just causality see?

Alternatively:

Person A committed an act that is not a crime.

People who commit acts that are not crimes are not subject to criminal prosecution.

Therefore...person A was not subject to criminal prosecution (which she would be, if she had committed a crime, but she didn't so she wasn't.)

I'm not sure why you keep remarking on this. She avoided the legal repercussions of the crime she didn't commit by not committing the crime.

If it makes you feel any better snr73, I get what you're trying to say. I've read all your responses here and I agree. She didn't commit a crime ergo her not getting jail time isn't a miscarriage of justice. (Please excuse my triple negative).

Its like this:

I beat a guy at chess once. He got mad and blurted out: "Things would have been different if this had been checkers!"

So, to put it another way: If we had played a different game, the outcome would have been different.

To simplify it further: If some things were different, then other things would be different.

No shit, amiright?

If she had made a false allegation to police, she'd had committed a crime.

No shit. But she didn't file such a report, ergo no such crime was committed.

It seems like people are confusing unethical behavior with criminal behavior. She got sued for libel and had to recant. She got the proper action for unethical behavior (a.k.a. what actually happened).

No, she wouldn't have. She would have gotten a pussy pass on it.

Generally speaking, the only time a woman is prosecuted for making a false report of sexual assault to police, is when she makes a non-specific report of a rape by a stranger, which sets of a manhunt. Cops charge her for "wasting police resources" or some such crap, because they had to spend a lot of time investigating.

Conversely, when a woman makes a false report of rape to police, accusing a specific innocent guy of raping her, despite the fact that the guy is often battered (taken in to police custody against his will), and sometimes jailed (false imprisonment), she almost always gets off without any prosecution whatsoever. They usually just tell her victim to "suck it up" for the ladies, because ostensibly otherwise some other girls might not go to the police or whatever garbage.

There are occasional exceptions to this rule, but generally speaking it's true.

Well, that's a different argument entirely. I didn't say she would have automatically been prosecuted, or convicted of a crime. I said, if you commit a crime, you are subject to criminal prosecution, if you don't, you don't.

These commentators have been making cynical statements about how she's not going to jail as if she had committed a crime she could be prosecuted in a criminal court for.

When questioned about it, they have talked about how, well, if she did, she would have or "should have."

My argument has nothing to do with whether or not someone who makes a false report to the police, is, in practice, prosecuted or convicted for that crime.

My argument was about the posters "arguing" that if she "had" done something, the results would have been "different" and getting sick of the tautologies.
