According to http://www.dmlp.org/legal-guide/new-york-recording-law New York is a one-party consent state. That means that as long as you are involved in the conversation, you can record without informing the other party.

However, since it's also her property, the "expectation of privacy" may supersede this. Just not sure about that.

You can do anything you want as long as you keep it to yourself. If it needs to be used then being it to your lawyer after the fact.

As ThePlague said, you can record audio without her knowing. You can have video in the bedroom too, as long as it isn't for salacious or sexually gratifying purposes- and you don't disseminate the video except to your lawyer.

Sucks that it's your wife since that means your married. And that you feel that way to do that. But yes very smart move. Always protect number one. Yourself. I'd say have all that stuff up. Audio recorders too as back up for potential not video use. Dont tell anyone!! Only yourself and lawyer when time comes. Good luck bro
