This has actually happened. I was reading an article about some country that makes men and women eligible for public pensions at different ages, so a man identified as a woman to gain earlier eligibility. It was in the courts the last I read.

It isn't hard to change your gender in most states these days. You just get a doctor to diagnose you with gender dysphoria and then request a new birth certificate, and then with that get everybody to correct your gender in their systems and get a new ID. You don't need to do anything else legally.

Now, that probably won't help you in family court or whatever because the judge isn't going to actually legally cite your gender but will be just as biased against you. However, it probably will cover you for any situation where there is an outright policy favoring one gender or another.
