They aren't gender neutral, they are written with gender neutral language. You have to ask why the law is being written in the first place.

For example, if I wrote a law saying all person's with long hair should be fined $100, that is a gender neutral statute, but it would have an extremely disproportionate effect upon women.

Laws are just written words fair and neutral by itself but interpreted, decided and implemented by people. I trust the written words but I don't trust people since we are still emotional beings. They might be educated and experienced in law but still emotional. It's easier to sympathize to a crying woman with victim attitude than to a man. If we hide the gender of both parties when presented in court the result would drastically change. By default, the mother is the primary custodian of children. Good luck breaking that tradition and that's the first hurdle.

Because of false stereotypes of men and women. Such as women are the better parents, women are more nurturing, the child is assumed to be better off with mom, that divorce is always the man’s fault, that all men are rapists and abusive, that all men are deadbeat dads, that all men don’t want custody of their children, that all men are bumbling idiots incapable of successful parenting. And on and on. Gender neutrality in family law cannot remove societal stereotypes which disenfranchise men in these disputes.

This is my experience with divorce law...your experience may be different but it may help provide an answer to your question.

Divorce laws aren’t biased in favor of women. They are biased AGAINST the higher earner.

now, because very few women will be with a man that makes less than them, most of the time the man is the higher earner in a marriage.

Ergo, divorce laws are biased against men and in favor of women.
