It's fascinating how this article is written somehow this Evil wealthy old man made a "mistake" in not leaving his extremely charitable wife who has done nothing but good for 42 years without a penny.

She somehow managed to only have $3500 to her name and yet he chose to ACTUALLY leave the money to two tenants he felt were kind to him ?

This is more common than you think. In some countries, a divorced spouse can still contest the will - and win!

The advice I got was to both: always leave them something substantial, and write explicit instructions to the judge in the will why you are leaving them a smaller amount.

Basically you cannot stop certain people from contesting your will. And if your will is contested, then you need to provide clear instructions to the judge as to why you did what you did, and leave them thinking "well this people got something in the first instance, so perhaps based on the presented circumstances we can just leave it at that."

Here in Brazil any will can only distribute 50% of your assets.

50% of any undistributed asset is granted to the wife. The rest belongs to offspring. No contract would be deemed valid in a court of law to waive this right, even if the wife/children signs it.

A lot a responses from the community on this one. Let’s remember this is not an opportunity to harp on women but learn from this mans mistake.

In case you didn’t read the article, a man worth 2.1 million dollars left his wife nothing in his will. He was dying from prostate cancer while living on the estate valued at £318k, while she was living in a nursing home off of benefits with a saving of £3500. The courts deemed it okay to go against the mans last wishes and she got the estate and a cash amount of £225k.

She only got a quarter of his assets. We have seen it go much worse. How do you think her age effected the outcome?

And lastly, I’m my opinion the only way to actually prevent this from happening is to put all your large investments or assets and put them into multiple limited liability companies, not just one. They can’t take what you have if you don’t have shit.
