That is a lot of “monthly morphine equivalents” for one person - even not knowing the amount of morphine she is prescribed. If she has legitimate pain she may not be high if taking the oxycodone and morphine properly although you are right to be skeptical. Doses that high, nowadays, are usually only for people with cancer pain or tapering down from an even higher dose. But not for back pain.

How high she is is subjective; the people who know her best (i.e. are around her most) are the best people to judge whether or not she is altered/high. For obvious reasons the judge may not completely trust your opinion. If you have been keeping a diary of her mental state/actions you may have something more compelling for the judge.

If she is taking them chronically and the drug screen is specific for them (not all dug screens test for or will show all opioids) then they should show up on the screen. Typically if a patient is taking narcotics chronically and has a negative random drug screen they are presumed to be diverting them (i.e. selling them). I would certainly expect to see oxycodone on any random screen she took. I do not know what kind of weight a negative drug screen (when expected to be positive) would carry in a courtroom; I have more experience with positive drug screens when they should be negative. Remember too that the typical drug screen is yes/no - usually doesn’t measure the actual amount present. So while you would expect someone taking 90 mg/day of oxycodone to have a high level of it you don’t know what the level is. One oxycodone the day before will show the same as three oxycodones the day before in most drug screens.

Your challenge would be forcing her to do random drug screens; usually takes a court order.

A lot of this may depend on the specific judge and I would suggest asking your lawyer about how to approach this issue.

There is no way her blood will be clean. These drugs stay in your system a long time. You said she looks high, so must take some and sell the rest.

If she has a legal Rx for these medications, her blood work won’t mean anything. All it shows is that she’s being treated for back pain.

However, if you can prove that she is selling them....it’s a different ballgame.

Can you request that both parties submit to drug testing?
