I’m scheduled to be deposed at end of month. Any advice other than not to lie?

This is not your turn to win the case and tell your story. That will happen at trial on direct exam.

Listen to the question. Answer the question. Nothing more. Don’t volunteer extra information that is not asked.

If they ask what you had for breakfast, the answer is “toast” or “cereal”. Do not say where you ate, who you ate with, how much it costs, if you enjoyed it, etc.

If the attorney asks the follow up question, fine. If they don’t ask, fine. Just answer what is asked and not what you think they want to know or should know.

The correct answer is usually 1-3 sentences. If you are talking longer than that you probably are not answering the question anymore.

You should have your lawyer there. They can step in and tell you to shut up or say do not answer the question as needed. They can also get a time out if you need it or if they need to talk something out before you answer so you do not get in trouble.

Pause and wait a while before answering any question. Count to 10 or some random number before answering. Depositions are usually scheduled to last only a certain amount of time. The more dead air, the greater likelihood of fewer the questions and followups. Most of your answers should be.. "Yes", "No" and "I don't recall".

Look the opposing council in the eyes and smile a little when appropriate.

Use extra deodorant that day and make sure you have a glass of water in front of you. If this is your first deposition, likely you will get nervous.

Try not to show emotion and by all means, do not show anger no matter what they ask. It might not hurt to practice with your attorney or a friend of yours.

I imagined this to be true. I’m pretty deadpan as it is. I’m hopeful, but know that anything can happen.
