Why do women always get custody of the children in divorces?

States determine custody and other matters relating to child in accordance w best interest of child test. Some factors include: who was primary caretaker during marriage (ex: feed, bathed, felt a illness, ect); which parent's daily schedule allows for best care; which parent will provide most stable home life; ect (several other factors). These factors do not carry equal weight and it's left to court's discretion to determine. Generally, it just happens that mothers are the ones responsible for day to day care of children, so this factor weighs in their favor. This is especially true when children are younger in age. However, their is a difference between physical custody (where child mostly lives) and custodial rights (decision making for child). A child can live w one parent primarily, but both parents can retain custodial rights over the child. Additionally, depending on state, courts will consider the wishes of the child. In most states this consideration comes into play between 12-14. Of course, all of this is very broad and there are numerous other considerations which may come into play.

Whoever does the majority of childcare during the marriage should not matter because once the parents divorce the expectation should be that these duties must be divided from then on. Likewise, we would not expect that just because the husband was the breadwinner during the marriage, he must continue to be the main worker after the divorce (though courts frequently treat men as such).

NOW has consistently shut down legislation for automatic 50/50 custody policies in divorces because of fear mongering. They insist that this will allow children to stay with abusive fathers, even though obviously an exception could be made for that and more.

There's this thing where women are able to point at any possible scenario that might affect them negatively, no matter how unlikely, and use it as a reason for why we must have something.

So, scrapping alimony altogether might hurt older women who have never worked a day in their life, we can't have that! A woman might not feel like she can say no to sex, therefore all men must ask women if they want to have sex. And women must always get default custody of children because what if the husband got it and he was abusive?!

Because the legal system is fucked up, sexist towards men and almost always sides with the women. Even though in some cases the man can take better care of the child than the women in custody cases. Breaks my fucking heart.

Why do women always get custody of the children in divorces?

Custody of children is awarded to women due to the sometimes mistaken assumptions/belief that:
a) women, having given birth to the child(ren), have a bond with the child(ren) and so would not cause harm to the child(ren);
b) women are natural care-givers, and so would not cause harm to the child(ren);
c) women are less likely to use the children as pawns in power games;
d) women are significantly less violent than men, and so would not cause harm to the child(ren).

These assumptions/beliefs are not absolutely/universally true!!

But...this is why women [always] get custody of the children [in divorces]...
