Violations of disclosure rules by police are occurring in 40.7% of cases, according to Inspectorate reports. Police failing to share key information from their investigation is the number one cause of miscarriages of justice. We do not believe that all police officers are cheating to win cases – often its matter of lack of resources or training. However, we do believe that the police should not be the ones to decide what gets turned over to the defence, as their job is to put together the case against the accused.

Simply appalling. This is one of the problems with politicians preaching "touch on crime" rhetoric or, in the case of feminists, demanding that conviction rates be increased for alleged rape cases.

Few like to admit it but at the end of the day the police are a political organization. They have a hierarchy and chain of command and the police chief is answerable to his boss and up the ladder we go.

The first and foremost concern of any system of justice should be to keep innocent people out of prison. Everyone in the legal profession should be forced to recite Blackstone's formulation every fucking day.

Blackstone's formulation

In criminal law, Blackstone's formulation (also known as Blackstone's ratio or the Blackstone ratio) is the principle that:

"It is better that ten guilty persons escape than that one innocent suffer",

...as expressed by the English jurist William Blackstone in his seminal work, Commentaries on the Laws of England, published in the 1760s.

Historically, the details of the ratio have varied, but the message that government and the courts must err on the side of innocence has remained constant.

Which is why I oppose the claim that prosecuting false accusers will discourage victims to come forward. The latter should be helped and encouraged to come forward. But, if they choose not to, that should be that. The priority then should be prosecuting false accusers and protecting innocent men.
