To be fair she does “claim to have stable housing” so she’s not currently homeless. But of the two parents only one seems to have already proved stable living conditions on an on going basis. Plus the father is showing responsibility by going back to school, even if online, to improve his standard of living. A standard of living he hopes to give to his kids from his push for custody. Taking gender out of it, which should always be the case, there is one parent who is undeniably making more responsible decisions, and that’s where the children should go. Crazytown, USA.

Mother of my children moved to a place she couldn’t afford to live to keep me from seeing my children. We had 50/50 custody for several years. She ends up homeless and hides it from me for 2 months and told my daughters not to tell me or they would never see her again. I was picking them up every Friday during that time at alternate locations with excuses. The statement that makes me sound like I don’t know where my kids would go to school was taken from me telling the judge that I had spoken to the school district and it would be one of the 2 schools within blocks of my house, but they wouldn’t know until closer to when the school year started. She moved in with some white knight in the week before trial and was homeless at the hearing immediately before. My children were spending their afternoon at the library until it closed at 6pm with no adult supervision at age 11 and 12. CPS has been involved since she moved twice because the school was concerned. One of the interviews determined she was violent with my youngest daughter. This was all discussed in court but not mentioned in the findings. It was also not mentioned that the “job” she had was unpaid as part of school and a 45 minute commute from their schools. The white knight also lived 40 minutes away from their schools, and they had to commute to school over an hour a day. The bias of which facts were chosen to be included, and which facts were “important” to guide their decision is completely beyond my comprehension.

Men cannot get primary custody of their children from a homeless, abusive, neglectful mother. In California. In the best interests of the children.

How bad of a person would I have to be to make this choice logical? A criminal? What kind? Drugs, violence, or sexual crimes? What if I told you I have never even been arrested.

My guess is that she will not be able to meet the conditions set in the last two sentences, but will obfuscate or lie about the fact. You need to have the evidence that she has not maintained the required stability.

What the hell are you all complaining about? The justification for the decision is right here, and it makes sense.

The court doesn't want to disrupt the kids existing life - they don't want to pull them out of school, move them to a new town etc. without a good reason.

That means if the court can be reasonably certain that there is a good chance the kids will have stability in their mom's household then they would prefer to keep the kids where they are rather than upheaval their lives.

They go on to stipulate that if mom DOESN'T succeed in maintaining a home and a life for the kids, then they will decide the home is unstable and take the kids away. But they will only do that if the mom demonstrates that she is incompetent / incapable of providing. So if mom screws up, the kids get taken away. Until that day, the kids stay where they are.

That doesn't seem all that unreasonable to me.
