They were both aware that I was recording, and I was in my room in my apartment, but I never got their permission.
It's vague you're right, but basically if I admit to recording them and they decide to say they didn't give approval (even though they could see and were clearly aware that I was recording before they started speaking) then i'm fucked and not only will I get a felony eavesdropping charge but a possible rape charge based on her false account, just because she wants to spite me. I'm considering suicide.
IDK, they didn't give me a reason. The Title IX policy PDF from my school just says i'm only allowed a trained adviser provided by the school during the meeting with investigator. I am in contact with FACE and they are getting me in touch with a lawyer that has Title IX experience and I think they will consult with me pro-bono. I feel more confident as time goes on that the investigators will see the truth in all this, but I can't be for certain. The only way to protect myself and my future is to actually get in touch with a lawyer. I've been losing sleep over this shit and I couldn't even focus on my class. It makes me really hate this girl and afraid to ever hookup again. I have had two girls ask me to hookup in the past couple days and I just didn't even reply them because thinking about sex scares the fuck out of me. How can i prove ANY sex with ANYBODY is consensual? Especially in IL where the recording laws is two party consent apparently. I did some research tonight about consent forms and apparently not even consent forms hold up in a court of law. WTF?!
No lawyer allowed, only trained advisor provided by the school, but the advisor cannot speak on my behalf. They can only be there to advise me during the investigation.
Should I ask them? Since it's IL I think I have to get two party consent, but it's so fucking vague and the 2014 ruling still doesn't make it clear whether 1-party or 2-party is required
Thank you so much. I'm trying to find a lawyer tonight that I can go consult with tomorrow. What kind of Lawyer should I talk to? A criminial lawyer? I don't see any "Title IX" lawyers in my area. I am very poor, like dirt poor, but I am willing to put myself in debt to a lawyer for an action plan that I can take with me to the investigation.
I want to go to war, in my email to the coordinator I said I sincerely hope that there will be consequences to the accuser for false allegations and I haven't said anything to them about my socio-economic status to make them think I can't afford a lawyer.
The fact that she doesn't even go to school here would probably prove that they can't do much to her in that case though.. I'm fine with that as long as they put this to rest.
I just thought of the idea that what if I contacted the police proactively and let them know of the on going title IX investigation? Would this help me? I want them to be aware of the fact that she might approach them and attempt to create a false police report.. Though, I don't know if this would hurt or help me. What do you think?

I just found out that Illinois is a two-party consent state for conversations.. So I guess i'm fucked. Idk what to do.
