I assume the same rules to public filming should apply even when in the nude.

Namely you are allowed to be filmed so long as no specific focus is drawn to you. This would violate that.

However at the same time if they are punished any more seriously than someone who might do this to a normal girl on the beach who is wearing clothing then that is a double standard. Pretty sure standard policy would be to delete the video and inform them of how such things aren't legal.
