It's an important question. This law did not require a conviction. I don't think most people here would object to convicted rapists being barred from having any custody rights to their children, but the way the law was written it wasn't banning "rapists" it was banning "alleged rapists" from having custody. Regardless of what people think of how common false accusations are, if you tell women "you can get sole custody by accusing the father of rape" you're obviously going to get a lot of false accusations

I think it largely depends on how old the case is. Over time people, especially women, alter the narrative in their memories. This accounts for extreme discrepancies in statistics which ask about whether you have been raped/sexually assaulted in a given period of time. Statistics show women are increasingly likely to say they have been raped the further back in time you go.

This is only one reason there should be a statute of limitations on these matters.

I have been looking for them, but cannot find them. Basically, this relates to a self-reported survey in which women reported having been raped or sexually assaulted over a long-period in numbers that were so much greater than over the short-term that some serious explaining was required. Figures for men meanwhile, were consistent over the various reporting periods surveyed.

Can anyone help me with this? I would very much like to be able to find it again.

On the numbers, we have no real knowledge. The minimum number is 2% but fair estimates range from 20-40% in general with the highest I've seen being 60%. Unfortunately, it is really hard to know how many were lying and how many dropped the case for other reasons or just never had their case pursued due to lack of evidence. 80% of cases brought to the police are deemed unfounded, a percent of those are just that there was no evidence and some are legitimate lies. And there have been studies done that go through all of those cases to see if they were rightfully judged unfounded and just about all of them were corrected found unfounded by the police.

I can tell you this: In a lot of cases where the police do find evidence of rape (even when they believe the victim) it won't be enough to convict, so they will advise against going to trial. This applies about 5 times as hard to men, whom trials are almost never won.

If it reached 10% of the time I would be against the law being changed. ("We should set our laws so that if 10 are convicted and even one is innocent, all ten go free." Bastardization but close enough to who ever said it.)

This is the number of rape accusations that result in a guilty plea or verdict of 'filing a false police report' against the accuser. There are enough well known and obviously false accusations that never got prosecuted to know that the actual statistic is higher than that.

Eh. Well I didn't even think about it, and I think trying to incite a witch hunt is against reddits rules, but I'm not really trying to do that.

Its not like you can't just delete your reddit account and start a new one, so I would be slightly shocked if it were a rule.
