It’s not uncommon for universities to limit the role of attorneys or advocates in internal disciplinary proceedings. I’ve worked on a number of cases where clients were denied help in front of campus tribunals, including one memorable case where a student’s own mother wasn’t even allowed in the room for moral support. It’s one thing to do this for alleged violations of, say, campus academic policies. It’s another thing entirely when a university is charging a student with committing a serious crime. In either case, it’s improper to so drastically limit the student’s defense, but in the case of claims of rape or sexual assault, it’s egregious.

Wait I don't get it, maybe it's because I live in Switzerland and know barely anything about law, but is this literally saying that the universities can stop you from getting someone to defend your rights ?

I must be getting this wrong no ?

Yeah it's anything goes.

I've experienced this. A woman who had threatened me in writing for refusing to date her (that's her sexually harassing me) falsely accused me of harassing her. A gay man. When they told I was gay she immediately withdrew her malicious complaint and made a full written confession, bizarrely claiming to have always known I was gay. In her own handwriting which they had samples of courtesy of supposed diary entries she had submitted.

Oh good outcome, you're thinking? No. The university refused to even consider her confession on the grounds that it came into existence after the investigation began (a bizarre standard of evidence only applied to this piece of evidence) and instead falsely claimed that I partially confessed in a particular document where I definitely didn't.

Nor would the university investigate my complaint of harassment against her. I got the revolving door of excuses for that one.

You do not want to be a man in a university today.

I'm in Australia and that happened in 2003. Things might be about to get worse too.

There seems to be a big push for our universities to dive down the same rabbit hole that US ones did. Lots of media stories about the problem of sexual assault and putting the onus on universities - rather than the criminal justice system - to investigate and stop it.

There's a big federal government report due out on it this year. I made a submission of course, and volunteered to talk about my experience. But the media don't seem to want any focus on male victims and especially not gay male victims of female harassment and false complaints.

Universities are working hard to demonstrate why you should never allow inept amateurs to undertake something as important and serious as investigating alleged criminal acts then determining guilt or innocence.

The universities should never have gotten involved in this whole thing in the first place, it should have been left to the police and the courts all along.

The university holds the hearing to decide if the student code of conduct has been violated, they dont have jurisdiction over actual criminal cases. This isn't a court of law, so the university is limited to academic probation, expulsion, etc. And it isn't held to the same standard. But apparently the restrictions of the rights of the accused have been too egregious, according to recent judgments in favor of the accused students.

How can this be monetized?

Having a judge embarrass a university and force them overturn there own decision and readmit a student is one thing.

But it isn't enough.

The ONLY thing these schools will listen to is if there wallets are hit hard.

What needs to happen is a lawyer and client need to be made seriously, filthy rich by suing the school. Then others need to follow.

People do not understand lawsuits. This is what they are for.
