I've never heard prison referred to this way. But being that the overwhelming majority of prisoners are male (men are incarcerated at much higher rates than women for the same crimes) it is hardly problematic to use a male pronoun when referring to generic prison inmates.

The discretion of judges in sentencing is limited. If an offence has a 10 year limit and a 4 year minimum, the default sentence might be 5 years. A judge has to state the reasons for giving a particular sentence and these can be challenged on appeal by reference to other sentencing decisions.

Same with getting convicted in the first place. The judge has to justify their judgement. Often they are forced to give a verdict that does not suit justice, because they have to follow the law. Usually this means acquitting someone who is pretty obviously guilty but it can also mean convicting on a charge which has a harsher penalty than is fair.
