I don't understand why she hasn't been charged with rape. That's the problem here. I assume the article can't mention rape if she hasn't been charged with it.

Possibly that there's no evidence it was forced (even though it would appear as if it was) and it's easier just to charge her with statutory rape instead?

Which would be understandable, if she was actually going to be punished for the statutory rape. If she's just going to plead it down even further to probation, which seems very likely, that's the problem.

It says more charges could be coming, but really? 2 counts of lewd and lascivious behavior/sexual activity with a child under the age of 16?

EDIT: I just looked up the penalties for that crime and found this (emphasis mine)

Most defendants are concerned about how much jail time they will have to serve after a conviction. Many states will impose punishment from two to forty years in prison. If a defendant engaged in multiple acts, he could be charged under a continuous abuse statute and be required to serve a minimum of twenty-five years in prison before becoming eligible for parole. If a defendant has a prior conviction for any sexually related offenses, some states will automatically impose a life sentence.

I looked up the punishments specifically for Florida to get a better idea what she might be facing.

If convicted of Lewd and Lascivious Battery, a judge is required to impose a minimum prison sentence of 34½ months in prison

Which sounds nice, but then of course you have three exceptions that can allow the judge to go below the mandatory minimum:

The child was an initiator, willing participant, aggressor, or provoker of the incident

Not sure if they can argue this if he's saying she threatened him with a knife, but they'll probably try.

The defendant requires specialized treatment for a mental disorder (unrelated to substance abuse or addiction) and is amenable to treatment; or

I'm willing to bet they go with this one.

The defendant is to be sentenced as a youthful offender before the defendant's 21st birthday.

Clearly not applicable.

These "mitigating circumstances" seemed to be designed just to ensure that this mandatory minimum only applies to men, though. Seems the idea is you give enough loopholes so that when a woman is charged you can always find one that applies, and you can just ignore them when it's a man that's charged, and then you have a mandatory minimum sentence for men that doesn't interfere with giving women probation!

Not to mention, the rest of the wording in the original source for the penalties refer to "a defendant" and this was the only time they used a gendered pronoun and it's in the context of sexual assault on a minor
