Hi all,
Wondering if my worry is warranted or not - any words or advice are appreciated. I pay my ex wife app. 4500 per month in alimony and child support. Been paying for 3 years now. My divorce agreement says that should be paid on the 1st.
Last year I fell behind a two times and paid her half first of the month/next half 15th (2250 first, 2250 15th). She took me to court over this. They obtained wage garnishment... (funny thing was the wage garnish order was for half on the first / half on the 15th!). employer was sending it over late as well for a few months.
Ex took me back to court - so now they shifted it back to me - pay the entire thing "monthly" / remove wage garnish. No problem.
Except...
This month on the first I sent her half and on the 1st and on the 15th will send her half again. I'm really tapped - although I had the full amount I needed it to pay bills.
I go to court next month. Of course Ex will say he paid me late again. (this month April).
Is this cause for concern? The judge is always very short / abrupt / angry toward me, so I'm thinking that my ex and her could say the divorce decree says pay by the first, not by the 15th. Yet the court order says "Monthly".
Would the judge hold me in contempt for the 15 days late (and I'm confused since the order says Monthly).....
Thanks for any help / insight.
