I appreciate all you guys do on here. In my divorce decree under Personal Property Rights there's a line item "D" explaining how my 401k is divided. The first sentence states "The husband agrees to withdraw half the amount of his Retirement account within 30 days of the date of divorce". I plan to speak with my lawyer this Friday, but 30 days has come and gone and the ex is filing contempt. For whatever reason my nor her lawyer addresses this during the divorce and I've not had a few grand to drop on another lawyer to execute the qdro. My question is I've always thought that the rule of thumb is the divorcing parties would split the cost of the qdro. The way its worded in that" I agree to withdraw the 401k amount", is there anyway that would give me leeway in that it doesn't specify who is responsible for paying for the qdro? I plan on paying to have it done within the next several weeks when I get the money, but she's not having any of that.
