Hey there, like many here, I'm going through a divorce right now. We haven't brought in lawyers yet, but I think that's probably the next step. The wife really wants our home, which we own together. She wants full custody for two years (full visitation right for me, they just stay with her), which I'm inclined to agree to (taking care of some personal stuff). I'm totally fine paying child support and maintenance, but she wants me to sign over the house to her, and give her a portion of my retirement. I think that's a bit much...
Ideally, she would get to live in the house with our kids. She makes very little money, as she's been a stay at home mom for the past 7 years. So there is no way she could afford the mortgage on her own without some major job status change (she's part time now). Anyway, Colorado is an equitable distribution state, meaning property, assets, and debt is distributed in a fair, but not necessarily equal manner. Colorado is also a no-fault state.
I'm fine dividing everything 50/50, but in order for that to really mean anything, the house would have to be sold... I don't know, just spinning my wheels here trying to figure out a way for her and the kids to stay there without screwing myself over.
She was the homemaker, and I was the breadwinner. I've paid every mortgage bill for the past 3 years. Whatever my strengths or weaknesses were within the relationship, I've always worked and been solid on that front. I don't want to simply give away that equity we have in the house. I'll admit, I was considering it as an act of ultimate goodwill, but the fact that she is now seeing someone else, and the realization that the gesture ultimately was a way (in my mind) of currying her favor and possibly winning her back, has me reevaluating the situation. She has absolutely no intention of patching things up.
