The courts like the Status Quo. If you are looking for a certain custody percentage, then you have to fight for every inch. Courts all too often say, "out of the abundance of caution, we give the dad visitation only because he hasn't been with the kids exclusively, and then we can revisit later." And then later never comes, does it? Because the courts want to keep the status quo.

I wanted 50/50 custody. In my case, I had to show evidence of all the times I had the kids exclusively with me. It helped to say, "Yes, the kids were with me when she was in jail from her DUI."

As these other guys are saying - things are more prone to stay the way they currently are. It takes a great degree of effort to change things later. For my situation, establishing a temporary custody arrangement came with an explicit end date (this was done in mediation, not court). I think that prompted development of the final arrangement a bit easier. It sounds like you are considering setting a temporary arrangement before your stbx moves away - that is certainly something you should do, if you can’t make it past the goal of a final custody arrangement before she moves.

I was about to loose everything i worked for all my life..... my ex almost took everything I worked for all my life.
