I’m in Maryland. Not a community property state.

I keep hearing it’s a state by state issue of including the cost of selling when calculating a buyout.

I’ve read that since I will eventually have to pay commissions and fees to sell the house, then she should have half that cost taken from her buyout when I calculate the buyout amount.

Does anyone have any actual experience with this? Or know the actual law?

Total equity is about 85k and she owns 37%. I had a real estate agent draft a selling cost and net profit estimate based on the appraisal we paid for. Cost to sell is about 55k (1.1m sale price).

I’m calculating her equity at 30k .37 = $11,100

Obviously if I can’t deduct that 55 she gets $31,450.

Big difference.
