I went through a similar scenario. Initially when my ex filed she put her income as 12,000 per year and the ex parte temp order used that number. I tried to get that number to be recalculated since she had previously earned 90k per year and currently is only working 6-10 hours per week, they increased her imputed income to 18,000. At the final trial, we tried to get it recalculated again because since the last hearing she still wasn’t working full time, they imputed it as 40,000 per year.

So the judge did increase it, but they also made changes to my income to include certain things or exclude things from the child support worksheet to make sure that my ex’s child support payments always remained the same.

Once I get her tax return for 2024 I plan on trying to recalculate the number since she is still only working 6-10 hours a week even though the kids are either in school or full time daycare during the week. She has the potential to earn more than I do if she works full time, but she won’t do that until her savings run out and alimony stops since she spends around 3x the value of the child support each month.

For parenting time, it was significant change. My ex took out false restraining order which got dismissed and many other things that my kids had a whole 4 hours a week with me. Nearly a year later, I got weekends and a written parenting plan that in 3 years got our kids up to 50/50.

My ex had a really bad lawyer, which even though she's gone her influence is still a nightmare. She should have requested temp alimony and child support but she didn't. Tried to get back on both but the arbitrator not only said "no", she said "hell no".

As far as alimony and child support, it was bad. While the arbitrator followed the formulas in the laws, my State has a stupid exception for kids under 30 months. That meant her income was imputed very low.

The most important thing to remember is that during the divorce the court is going to make incomes nearly 50-50. The alimony you’re paying is called pendente lite. The final alimony ruling may be well below this amount. In my case I was paying around 1300 for both pendente lite and child support. When the divorce went final my monthly payment fell down to around 900 since I didn’t have to pay alimony. My ex and I had a number of bills however thanks to her running up cards so I had to pay a big chunk of that.
