The settlement says non-modifiable alimony in a lump sum over a 5 year period. This means if she remarries or gets a job, tht alimony stays the same...

There are plus and minuses to both. In my case we have to sell the house and I want to give her a lump sum payment from my equity at the time of sale in lieu of alimony. So after final settlement no alimony and it can't be modified. Now if she remarried or got a great job, I can't get that back (both are unlikely however).

First, no women is likely to remarry while getting alimony. And I doubt she will get a job that pays anything of value. Might not even be imputed to minimum wage 🙄

Paying off in a lump sum also means can pay extra to pay off early.

On the other hand if it's modifiable then either party can ask to change it at anytime that payments are occurring. Sure if she gets a great job or you lose your's you can ask for modifications, but she can also ask for more (length and money). The courts seem to favor increases over decreases.

So decide for yourself. I want a lump sum at time of sale of home in lieu of support, or unmodifiable with option to pay off lump sum, because that's best for me. I do not want my STBX to have the ability to ask for a modification. I want a clean break and know the most likely scenario is her asking for more (likely to be no modification request but don't eant to risk it or have that hanging over my head).
