If you have them through the week and she has them on the weekend then you don't have 50/50, you have primary physical custody. And the courts will very likely keep the status quo and officially give you primary physical custody and even award you child support from the mother if you request it.

How is the custody schedule stated in the divorce decree? If it says 50/50 in the decree but you've been the primary parent for the past few years you may want to take the opportunity during this court battle to change the original custody agreement to you being the primary parent and not 50/50. Hopefully that'll relieve you also from paying child support.

She’s going to need to have a very good reason to change the kids out of a stable routine. Judges frown on that sort of thing.

Go to court with evidence. Evidence that the kids are happy and well adjusted to have you M-F for school and everything else. Write it all down.

And then depending on ages of the kids? They can say for themselves to the judge where they want to live -- generally age 13 and up.

But yes, some judges are VERY biased that "children belong with their mother." And too much of it is "on the discretion of the presiding judge."
